RTE Act and State of Assam
The Right to Education (RTE) Act has become reality in Assam on July, 7, 2011 with the state Cabinet approving the Rules needed for implementing the Act. With this, Assam became the 19th state in the country to implement the RTE Act of 2009. The act is comprised in State RTE Rules, July, 2011. The State specific norms in compliance to RTE Act, 2009 is detailed in the rules.
The title of the RTE Act incorporates the words ‘free and compulsory’. ‘Free education’ means that no child, other than a child who has been admitted by his or her parents to a school which is not supported by the appropriate Government, shall be liable to pay any kind of fee or charges or expenses which may prevent him or her from pursuing and completing elementary education. ‘Compulsory education’ casts an obligation on the appropriate Government and local authorities to provide and ensure admission, attendance and completion of elementary education by all children in the 6-14 age group. With this, India has moved forward to a rights based framework that casts a legal obligation on the Central and State Governments to implement this fundamental child right as enshrined in the Article 21A of the Constitution, in accordance with the provisions of the RTE Act.
Features of Assam Right to Education (RTE)
- Free and compulsory education to all children of India in the 6 to 14 age group.
- No child shall be held back, expelled or required to pass a board examination until the completion of elementary education.
- If a child above 6 years of age has not been admitted in any school or could not complete his or her elementary education, then he or she shall be admitted in a class appropriate to his or her age. However, if a case may be where a child is directly admitted in the class appropriate to his or her age, then, in order to be at par with others, he or she shall have a right to receive special training within such time limits as may be prescribed. Provided further that a child so admitted to elementary education shall be entitled to free education till the completion of elementary education even after 14 years.
- Proof of age for admission: For the purpose of admission to elementary education, the age of a child shall be determined on the basis of the birth certificate issued in accordance with the Provisions of Birth.
- Deaths and Marriages Registration Act 1856, or on the basis of such other document as may be prescribed. No child shall be denied admission in a school for lack of age proof.
- A child who completes elementary education shall be awarded a certificate.
- Call need to be taken for a fixed student–teacher ratio.
- 25% percent reservation for economically disadvantaged communities in admission to Class I in all private schools is to be done.
- Improvement in the quality of education is important.
- School teachers will need adequate professional degree within five years or else will lose job.
- School infrastructure (where there is a problem) need to be improved in every 3 years, else recognition will be cancelled.
- Financial burden will be shared between the state and the central government.

Assam RTE Online Application Form Filling Parents to Special Attention to Parents
- To avoid cancellation of your form, before filling the form carefully read the required documents for filling the form mentioned on the homepage and the details of the documents to be uploaded while filling the form. And definitely upload all the original documents as requested. If faded, Xerox copy and illegible documents are uploaded, the form will be rejected.
- If any one of Aadhaar Card / Passport / Electricity Bill / Water Bill / Election Card / Ration Card of child’s father is proof of residence, then registered rent agreement is not required. In case none of the above grounds are present, the registered tenancy agreement – registered tenancy agreement as per Assam Stamp Act 1958 and deposited in the concerned police station will be considered valid. (Notarized rental agreement will not be valid)
